1. Introduction

Welcome to BJJ Vision AI ("BJJ Vision AI", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of the BJJ Vision AI mobile application, website, and related services (collectively, the "Services").

By downloading, accessing, or using the Services, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use the Services.

2. Eligibility

You must be at least the minimum legal age required to use the Services in your jurisdiction.

If you are under the applicable age of digital consent, you may only use the Services with the permission and supervision of a parent or legal guardian where required by law.

By using the Services, you represent that you meet these eligibility requirements.

3. Description of the Services

BJJ Vision AI provides AI-assisted Brazilian Jiu-Jitsu analysis and training insights.

Features may include:

• AI video analysis
• Position recognition
• Transition analysis
• Technique feedback
• Roll summaries
• Performance tracking
• Analysis history
• Premium coaching features

The Services are intended solely for educational and informational purposes.

4. User Accounts

To access certain features, you may be required to create an account.

You agree to:

• Provide accurate information.
• Keep your account information up to date.
• Maintain the security of your account credentials.
• Notify us promptly if you believe your account has been compromised.

You are responsible for all activity occurring under your account.

5. User Content

You retain ownership of all videos, images, and other content that you upload.

By uploading content, you grant BJJ Vision AI a limited, non-exclusive, worldwide licence to process, store, and use that content solely for the purpose of providing the Services requested by you.

You represent and warrant that:

• You own the content or have permission to upload it.
• Your content does not infringe any third-party rights.
• You have obtained any permissions required from identifiable individuals appearing within your footage.
• Your content complies with all applicable laws.

6. AI Video Analysis

When you request an analysis, selected image frames extracted from your video may be securely transmitted to our AI service provider to generate coaching feedback.

The complete video file and its audio are not transmitted for AI analysis.

AI-generated feedback is intended to assist your training but should not be considered professional coaching, medical advice, safety advice, or a substitute for instruction from a qualified coach.

Artificial intelligence may occasionally produce inaccurate, incomplete, or incorrect results.

You acknowledge that you are solely responsible for how you use any feedback provided by the Services.

7. Acceptable Use

You agree that you will not:

• Upload unlawful or illegal content.
• Upload content that infringes copyright, trademarks, privacy rights, or other legal rights.
• Upload abusive, threatening, discriminatory, or offensive material.
• Attempt to reverse engineer or interfere with the Services.
• Circumvent subscription or payment systems.
• Attempt unauthorised access to our servers or infrastructure.
• Use the Services for fraudulent or malicious purposes.
• Introduce viruses, malware, or harmful code.

We reserve the right to suspend or terminate accounts that violate these Terms.

8. Subscriptions and Payments

Certain features require an active premium subscription.

Subscriptions are processed through Apple's In-App Purchase system.

Subscription pricing, billing, renewal, cancellation, refunds, and payment processing are governed by Apple's applicable terms and policies.

RevenueCat is used solely to verify subscription entitlements.

You are responsible for managing your subscription through your Apple ID account.

9. Intellectual Property

The Services, including but not limited to:

• Software
• Artificial intelligence systems
• Logos
• Branding
• Graphics
• User interface
• Text
• Designs
• Documentation

are owned by or licensed to BJJ Vision AI and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, distribute, modify, reproduce, sell, licence, or exploit any part of the Services without prior written permission.

10. Availability of the Services

We aim to provide reliable Services but do not guarantee uninterrupted or error-free operation.

The Services may be unavailable from time to time due to:

• Maintenance
• Software updates
• Third-party outages
• Security incidents
• Technical failures
• Circumstances beyond our reasonable control

We reserve the right to modify, suspend, or discontinue any part of the Services at any time.

11. Privacy

Your use of the Services is also governed by our Privacy Policy.

By using the Services, you acknowledge that your information will be collected, processed, and stored in accordance with our Privacy Policy.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis.

We make no warranties or representations regarding:

• Accuracy
• Reliability
• Availability
• Suitability
• Performance
• Fitness for a particular purpose

We do not guarantee that AI-generated analysis will always be accurate, complete, or suitable for your training objectives.

13. Limitation of Liability

To the fullest extent permitted by applicable law:

• We are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages.
• We are not responsible for injuries, training decisions, competition outcomes, or losses arising from reliance on AI-generated coaching feedback.
• We are not liable for interruptions, delays, or temporary unavailability of the Services caused by third-party providers or circumstances beyond our reasonable control.

Where liability cannot legally be excluded, our total liability shall be limited to the amount you paid for the Services during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be limited or excluded under applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless BJJ Vision AI, Randova Limited, its directors, officers, employees, contractors, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of:

• Your use of the Services.
• Your uploaded content.
• Your breach of these Terms.
• Your violation of applicable law.
• Your infringement of any third-party rights.

15. Suspension and Termination

We may suspend or terminate your account immediately if:

• You violate these Terms.
• We suspect fraudulent, abusive, or unlawful activity.
• Continued access presents a legal, operational, or security risk.
• We are required to do so by law.

You may stop using the Services and delete your account at any time.

Termination does not affect any rights or obligations that accrued prior to termination.

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales, without regard to conflict of law principles.

If you are a consumer residing outside England and Wales, you may also benefit from any mandatory protections available under the laws of your country of residence.

17. Changes to These Terms

We may update these Terms from time to time.

Any revised version will be published with an updated Last Updated date.

Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms where permitted by law.
